1. Introduction

These Terms and Conditions ("Terms") govern your use of the Rental Car Proof website located at rentalcarproof.com (the "Website") and the Rental Car Proof mobile application (the "App"), collectively referred to as the "Service."

The Service is operated by Rental Car Proof ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

These Terms are governed by the laws of Spain.

2. The Service

Rental Car Proof provides tools and resources to help rental car customers document vehicle condition, including:

• Downloadable inspection checklists and guides
• A mobile application for capturing timestamped, geotagged photographic evidence
• Educational content about rental car damage claims and dispute processes

The Service is intended to assist you in organizing and preserving your own evidence. It is not a legal service, an insurance service, or a guarantee of any outcome.

3. Not Legal or Insurance Advice

IMPORTANT: Nothing on the Website or in the App constitutes legal advice, insurance advice, or professional advice of any kind.

The information provided is for general educational purposes only. It reflects commonly accepted practices for documenting vehicle condition and does not account for your specific circumstances, jurisdiction, rental agreement, insurance policy, or applicable local law.

You should not rely on the Service as a substitute for advice from a qualified legal professional or insurance advisor. If you are involved in a dispute, claim, or legal proceeding, you should seek independent professional advice.

We do not guarantee any particular outcome from using the Service, including but not limited to the success of a chargeback request, insurance claim, or damage dispute.

4. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement.

5. User Accounts

5.1 Account Creation

Certain features of the App require you to create an account. You are responsible for providing accurate information when creating your account and for keeping your login credentials secure.

5.2 Account Responsibility

You are responsible for all activity that occurs under your account. You must notify us promptly if you become aware of any unauthorized use of your account.

5.3 Account Termination

We reserve the right to suspend or terminate your account if you breach these Terms or use the Service in a manner that we reasonably believe is harmful, fraudulent, or unlawful.

6. Subscriptions and Payments

6.1 Free Tier

A limited free tier is available. The features available on the free tier may change from time to time.

6.2 Paid Plans

Paid subscription plans are available, including annual and lifetime options. Current pricing is displayed in the App at the point of purchase.

6.3 App Store Purchases

Where purchases are made through the Apple App Store or Google Play Store, the relevant platform's purchase terms apply. We do not process or have access to your payment details in these cases. Refund requests for App Store purchases are subject to Apple's or Google's policies respectively.

6.4 Cancellation

You may cancel a paid subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by applicable law.

6.5 Changes to Pricing

We may change subscription pricing at any time. Where a price increase affects your existing subscription, we will give you reasonable notice before the change takes effect.

7. User Content

7.1 Ownership

Photos and other content you capture or upload using the App ("User Content") remain your property. We do not claim ownership of your User Content.

7.2 License to Us

By uploading User Content to the App, you grant us a limited, non-exclusive license to store and process that content solely for the purpose of providing the Service to you. We will not use your User Content for any other purpose without your consent.

7.3 Your Responsibilities

You are solely responsible for your User Content. You confirm that you have the right to capture and upload it, and that it does not infringe the rights of any third party.

7.4 Data Deletion

If you delete your account, your User Content will be deleted from our systems in accordance with our Privacy Policy. You should ensure you retain copies of any photos or evidence you may need before deleting your account.

8. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of any person or organization
• Upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
• Scrape, copy, or systematically extract content from the Website or App
• Use the Service to make false or fraudulent claims against rental companies or third parties
• Interfere with the operation of the Service or the experience of other users

9. Intellectual Property

All content on the Website and in the App that is not User Content — including text, design, graphics, logos, guides, checklists, and software — is owned by or licensed to us and is protected by applicable intellectual property laws.

You may download and print materials from the Website for your own personal, non-commercial use. You may not reproduce, distribute, publish, or exploit any part of the Service for commercial purposes without our prior written consent.

The name "Rental Car Proof" and associated marks are not to be used without our express permission.

10. Downloadable Resources

Certain resources, including inspection checklists and guides, are made available for download. These are provided under a Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International license (CC BY-NC-ND 4.0) unless otherwise stated.

You may share these resources freely for non-commercial purposes provided you attribute Rental Car Proof and do not modify them.

11. Offline Functionality

The App is designed to function offline after initial login. Photos are saved to your device and uploaded to our servers when connectivity is restored. We are not responsible for any loss of data arising from device failure, storage limitations, or interruptions to connectivity before upload is complete.

You are responsible for ensuring you retain copies of important evidence on your device.

12. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied.

We do not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses or other harmful components
• The information on the Website or in the App is accurate, complete, or up to date
• The use of the Service will result in a successful dispute, chargeback, or insurance claim
• Evidence collected using the App will be accepted by any rental company, card network, insurer, or court

To the fullest extent permitted by Spanish law and applicable EU consumer protection law, we exclude all implied warranties and representations.

13. Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable to you for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of evidence, loss of a dispute or claim, or financial loss.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Spanish law or applicable EU consumer law.

Where Spanish or EU consumer protection law confers rights on you that cannot be excluded by contract, those rights are unaffected by these Terms.

14. Third-Party Services

The Service integrates with third-party providers including cloud storage, payment processors, and analytics services. Your use of those services is subject to their own terms and policies. We are not responsible for the practices of third-party providers.

The App is distributed via the Apple App Store and Google Play Store. Apple and Google are not parties to these Terms and bear no responsibility for the App or its content.

15. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice of significant changes where practicable. Continued use of the Service after changes have been made constitutes your acceptance of the updated Terms.

16. Changes to These Terms

We may update these Terms from time to time. The date of the most recent revision appears at the top of this document. For material changes, we will provide notice through the Website or App. Your continued use of the Service after any update constitutes acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rights you hold under the law of your country of residence.

If you are a consumer resident in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
